Reason for Policy

The Research Foundation for The State University of New York ("RF") is The State University of New York’s ("SUNY") administrative agent for its sponsored programs and technology transfer activity. Pursuant to SUNY’s agreement with RF, RF is obligated to conduct itself in a manner consistent with all administrative policies applicable to SUNY, and is specifically committed to follow "[t]he University’s Patent and Copyright Policy and implementation thereof. . .".

The State University of New York Board of Trustees adopted an amendment to SUNY regulation, Section 335.28 of Title 8 in the Official Compilation of Codes, Rules and Regulations of the State of New York, the SUNY Patents and Inventions and Policy (the "Policy") on November 3, 2016, which became effective on November 23, 2016.

Statement of Policy

Consistent with SUNY’s agreement with RF and RF’s commitment to follow "[t]he University’s Patent and Copyright Policy and implementation thereof. . .", RF, with no exception, hereby adopts as its own the following:

SUNY Patents and Inventions Policy, codified at 8 NYCRR 335.28;

SUNY Procedures for Disclosure and Management of Intellectual Property;

SUNY Guidelines for the Management of Intellectual Property;

SUNY Copyright Policy, codified at 8 NYCRR 335.29; and

SUNY Computer Software Policy, for applicable software disclosed before November 23, 2016.

Individuals conducting business in the name of RF in conformance with these policies (e.g., directing royalty distributions) must take care to observe 8 NYCRR 335.28(h), which requires that any technology disclosures received by the university prior to November 23, 2016 must adhere to SUNY’s prior Patents and Inventions Policy, and therefore SUNY’s prior royalty distribution model.
